RE: The tariff classification of an ignition switch and electric cables with connectors from China, Thailand or Vietnam.

Dear Mr. Ernst:

In your letter dated June 16, 2010, you requested a tariff classification ruling.

There are 5 different part numbers/items concerned. Each is an electrical component to be used with a small displacement internal combustion engine. These engines will be used to power lawn mowers, snow blowers and power washers.

Part number A09943-07 is a push-button Stop/Start switch which is rated for 15 amps. At time of importation, this item is not attached or connected to any type of insulated electric wire or cable. Part numbers A17416-04, 24929-03, 28208-03 and 30579 are all insulated electric conductors which are comprised of a length of electric cable (two insulated conductors within a common outer jacket) with a rotary switch (rated for 15 amps) on one end and an electrical connector on the opposite end. The length of cable varies for each part number.

The applicable subheading for the push-button Stop/Start switch (part number A09943-07) will be 8536.50.9035, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical apparatus for switching…: Other switches: Other: Other: Push-button: Rated at over 5 A.” The general rate of duty will be 2.7%.

The applicable subheading for the insulated electric conductors (part #’s A17416-04, 24929-03, 28208-03 and 30579) will be 8544.42.9000, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Insulated wire, cable …: Other electric conductors for a voltage not exceeding 1,000 V: Fitted with connectors: Other: Other.” The general rate of duty will be 2.6%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
